PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE.

1 FORMATION OF THE CONTRACT

These terms of sale apply to any goods ordered & supplied. From the Sodexa-Medicreme website at www.sodexa-medicreme.com and who’s contact details are as shown in 10.1, at the end of these terms & conditions.

These Terms & Conditions should be read carefully by you before you place an order for goods from Sodexa-Medicreme, You will be asked to accept these Terms and conditions, before placing your order. If you do not accept these Terms you should not place an order.

1.3 
No contract exists between you and Sodexa-Medicreme, for the sale of any goods, until we have received and accepted your order, and sent you confirmation, we shall not be under any obligation to accept your order but once it has been accepted, by our confirmation to you, there is a binding legal contract between you and Sodexa-Medicreme..

1.4 
You must be sixteen (16) years of age or older to order from the Website and by accepting these Terms & Conditions, you are confirming to us that you are sixteen years of age.

Any contract between you and Sodexa-Medicreme, is subject to your right of cancellation if you are a consumer, (see 5.1 below)

Sodexa-Medicreme, may change these Terms & Conditions without notice to you in relation to future sales.

2 AVAILABILITY, DESCRIPTION, AND PRICE OF THE GOODS

2.1 
All goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, Sodexa-Medicreme, will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods. Or put the goods

On Back order if you so request.

2.2 
The description, and price of the goods you order will be as shown on the Website at the time you place your order.

2.3 
Subject to 2.4 below, the price of the goods will be the price quoted on the Website at the date the order is received. All prices are quoted in UK pounds sterling and will, unless specified to the contrary on the Website, include P&P which is show separately on the website and payment section of our card service provider Nochex.

Every effort will be made to ensure that prices shown on the Website are accurate at the time you place your order. If an error is found prior to despatch of the goods, Sodexa-Medicreme will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, Sodexa-Medicreme will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods

2.5 
The price of the goods shown on the Website is exclusive of Value Added Tax (VAT) Note No Vat is charged by Sodexa-Medicreme (at the present time).

2.6 
Where the goods are supplied for export from the United Kingdom, you will be liable for complying with any legislation or regulations, governing the Export from the UK, plus the importation of the goods into the country of destination, and for the payment of any import/export duties, or taxes, which are or maybe levied on them.

3 PAYMENT

3.1 
Payment for the goods and delivery charges can be made by any credit card that is shown as acceptable on the Website, at the time you place your order, (presently being Visa, Visa-Electron, MasterCard, Maestro, Solo, Nochex) or as shown on the Nochex Payment page

3.2 
All deliveries are subject to prior authorisation of your payment.

4 DELIVERY AND RISK

4.1 
The goods you order will only be delivered to the address at which the card is registered to (if paying by card), subject to confirmation of your order, this is to stop fraudulent or unauthorised use of debit/credit cards .or (stolen cards,)

4.2 
All products ordered from Sodexa-Medicreme shall be sent to you via Royal Mail; occasionally a commercial courier service may be used such as UK Mail Couriers. We shall endeavour to despatch orders within 2 working days after receiving payment from you, or within such other period indicated at the time you place your order.

4.3 
Delivery charges may vary according to the destination and weight of your parcel.  If the cost of sending your parcel exceeds the standard charge we have shown on our website or the postal rates change then we will contact you with a revised cost, which we request you pay before we despatch your order.

4.4 
If Sodexa-Medicreme is informed that delivery cannot be made to your address, then we will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for delivery. 
 
 
 

4.5 
Every effort will be made to deliver the goods within a reasonable time period. If Sodexa-Medicreme is unable to deliver the goods within 7 days of receiving your order, then we will inform you as soon as possible, and you will be entitled to cancel the order and obtain a refund or re-credit for any sum that has been paid by you, or debited from you credit card for the goods.Sodexa-Medicreme will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

4.6 
You will become the owner of the goods you ordered and responsible for risk of loss or damage to them once they have been delivered to you.

5 YOUR RIGHT OF CANCELLATION

5.1 
If you are a consumer, you have the right to cancel the contract at any time up to 7 working days, after you receive the goods. Subject to the goods neither being opened, nor the security seals broken, damaged or tampered with, in any way. (This is because of the possible contamination of the products).

5.2 
To exercise your right of cancellation, you must give written notice to Sodexa-Medicreme, by hand or post, fax or email, at the address, fax-number or email address shown at paragraph 10 below, giving details of the goods ordered and their delivery address.

5.3 
If you exercise your right of cancellation after the goods have been delivered to you, you must return the goods to Sodexa-Medicreme, at your own cost, in an unused, and condition .and subject to the security seals have not been broken, damaged, or tampered with in any way, The goods must be returned to the address shown below by registered post. The goods must be adequately sealed, and you must take reasonable care to ensure the goods are not damaged whilst in your possession or in transit.

5.4 
Once you have returned the goods, Sodexa-Medicreme will refund or re-credit you within 30 days of receiving the returned goods for any sum that has been paid by you or debited from your credit card for the goods. Less the original P&P Costs.  (Subject to 5,1 conditions, as above)

6 LIABILITIES

6.1 
Sodexa-Medicreme, shall not be responsible for any defect in the goods arising from, wilful damage, accident, negligence by you or any third party.

6.2 
Subject to paragraph 6.1, if the goods supplied to you are in any way defective or you have any other complaint about the goods, you should contact Sodexa-Medicreme, by phone, or notify us by post, fax or email in accordance with the contact details at paragraph 10 below.

6.3 
Sodexa-Medicreme will not be liable for losses relating to any business (such as lost profits or consequential loss) which arise from any failure by Sodexa-Medicreme to supply the goods in accordance with the contract. 
 

6.4 
Sodexa-Medicreme shall not be held responsible for any delay or failure to comply with its obligations under these terms of sale if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights. 
 

7 DATA PROTECTION

7.1 
Sodexa-Medicreme will take all reasonable precautions to keep the details of your order and payment secure however Sodexa-Medicreme will not be liable for unauthorised access to information beyond our control, supplied by you.

7.2 
Sodexa-Medicreme does not, and will never, discloses buyers' information to third parties.

8 COOKIES

8.1 
Sodexa-Medicreme may use your contact details (very occasionally), to send you! And only you! future product information, or special offers from time to time, but will not inundate you with unnecessary information.

9 INTELLECTUAL PROPERTY RIGHTS

All Copyright in the material contained on the Website, and all of the Product Names, including all descriptions & text included in that material, belong to Sodexa-Medicreme.

You may download or copy the content and items displayed on our Website solely for personal non-commercial purposes, for such purposes like placing an order. However, Copying or storing any or all of the contents of our Website for any other purpose whatsoever is prohibited.
